You cant DDOS with us or us
You are not allowed to threaten, or use our services, or employees, members to do or threaten with DDOS attacks.
- You may be granted a refund within 48 hours of purchase, however we are not obligated to do so but will often do so on a event where you have a negative experience with Xenon Services.

You cant run Pirate Bay with us
Unfortunately we don’t tolerate Piracy Hosting.

You cant run a scam center
We know, it sucks your not allowed to scam people with our servers.

You cant Spam us or use our services to Spam others
Spam is no fun and you probably shouldn’t be contributing to that.

You can’t make false chargebacks
It isn’t fair to us when you make a false chargeback. It ends up costing us money and hurting us.
Person(s) who hold or operate a service provisioned by Xenon Hosting are considered Consumers. Xenon Hosting Terms of Service is legally binding to all provisioned services and related consumers.Purchasing or otherwise interacting with our services applys the person(s) interacting with said services to all policies excluding the SLA unless the person(s) has purchased a product from Xenon Services.
Xenon Services may be destribed as the terms, "We, Us, Xenon Hosting, Xenon, Xenon Services." These terms describe the buisness entity operating under the Xenon Services brand and all affiliated services, domains, services.
Xenon Hosting does not permit the following actions on any of our services, or products sold, held, or operated by a consumer.

DDOS attacks, threats, Bot Net or contributing to cyber attacks, described as a cyber attack or cyber crime by Washington State Law or Federal regulations and laws will result in termination of consumer status and products or services provisioned will be terminated without refund as well as without notice.

Theft, holding stolen property or currency is not permitted.

Piracy or torrenting stolen or unlicensed content to distribute to the public regardless of intent to sell or capitalize.

Selling products with a false pretense of delivery or with intent to not deliver the advertised product.

Crawling or using proxies to scan the internet with the intent to spam, scam or abuse a service for financial gain.

Failure to follow the CANSPAM Act or the ICANN Act and using our services or provisioned recourses to send spam or fradulent mail or EMail.

Spamming or sending large amounts of information to our support systems.
Xenon Hosting reserves the right to terminate services that use excess bandwidth or recourses then provisioned.
Violation of said Terms of Use can result in termination of any of our SLA policys while reserving the right to terminate any provisioned services, we also reserve the right to fight charge backs and refuse refunds in instance of violation.
We reserve the right to change or alter our Terms of Use.
Cancelling or requestion cancellation or altering a plan or subscription to end or remove the service, otherwise ending your subscription with Xenon Services unbinds the person(s) no longer subscribed to Xenon Services from the SLA. Clients or Person(s) with a concurrent subscription that has been requested or other wise will not renew in the agreed next billing period regardless of reason are no longer subject to the SLA and may not receive compensation for any Downtime, or otherwise listed items that would result in compensation. If a service is due to be terminated or suspended because of failure to renew, pay or otherwise reason of suspension and termination of service the Service is not going to renew and the time before the next renewal exceeds 1 month clients are permitted compensation and are within the SLA. When the clients have less then 1 month remaining before a suspension or the service does not renew, the client will no longer be able to claim or get compensation for Xenon Services failure to maintain the SLA.
Xenon Services has the right to apply compensation for any reason that would justify or was otherwise agreed that we would provide compensation in USD, Xenon Services Credit or gift cards.
Xenon Services reserves the right to terminate, Suspend, or end a clients service for any reason under the discretion of Respective authority's of Xenon Services. If we choose to suspend to terminate or otherwise terminate a service, product access, website access, physical labor, or server or hosted product Xenon Services is not Obligated to inform the consumer but may do so at Xenon Services discretion. By purchasing a service clients agree to not charge back or otherwise mark the transaction as fraud, if the termination or suspension occurred within 48 hours of purchase the client is permitted a 80% refund. 80% being 80% of the sub-total, tax, shipping and other expenses may be requested of the client, if a product requires a return or a physical product has been colocated, we will return the item to senders address, assuming the sender, or billing agent managing the colocation product pays the return invoice within 30 days of termination or suspension after 30 days the item is declared lost, or salvaged and Xenon Services will become the Legal Owner, and property Owner of said Item, and it may be sold, stored, etc by Xenon Services.
Furthermore we are not obligated to refund or cooperate with chargeback requests on the requesters behalf. On instance of a chargeback or other attempt to reverse a payment made to us for any product, service, donation or any instance where money would be transferred into our possesion may but we are not obligated to, result in complete termination of a customers account, order history, etc. Furthermore we are not to be held accountable for any dataloss, or loss of revenue, and any other effects in result of termination. Additionally for any reason we may but have no obligation to revoke and/or terminate customers accounts, products, orders, services, or any other relationship or service / product with us for any reason seen fit by us. Refunds in an instance of termination, deletion or otherwise non-voluntary expulsion or removal of access, network, power of a service, or product.
Failure to pay or otherwise not mantain proper billing behavior for a billable item may but with no obligation by us be terminated or otherwise non-voluntarly removed and we will not and cannot be held responsible for lost data, and customer accounts. All responsibility for lost data, and accounts should be held to the consumer as we always provide sufficient notifications on instance where a invoice is overdue. An invoice is only declared overdue when the payment has not been recieved by a payment processor in our possesion and has been agreed by both parties on use of by one billing term selecting in the payment proccess after the original agreed recurring payment. On instance of manual intervention under the discretion of Xenon Services the recurring date may be changed at any time with or without notice to the consumer if moving the date a invoice would be expected further. Xenon Services is obligated to give sufficient notice to the Consumer on instance of a invoice being due sooner, however it remains the customers requirement to pay said invoice as the term may be changed on discretion of respective authorities within Xenon Services.
Xenon Services reserves the right to engange and reverse payments made by a consumer on there discretion while Xenon Services is obligated to reverse a payment within 48 hours Xenon Services reserves the right to refuse said refund. When a consumer makes a support ticket or attempts to communicate with a respective authority of Xenon Services within 48 hours of an invoice paid, any invoice paid within 48 hours may be reversed and Xenon Services is obligated to do so but holds the right to refuse the reversal of money for any or no reason."
Xenon Services will not save or otherwise store consumer files and backups unless specifically stated in writing and established with a written agreement between both partys: Xenon Services & Consumer both of these entities are to be established as parties Xenon Services or Party A has no obligation to backup - or otherwise save and keep files in a retainable state. Xenon Services will not be held responsible for dataloss s or any other event where Xenon Services or Party B the consumer is no longer able to access said data due to a hardware or software failure or act of god.
